In 2013,Attorney Wang Xuezhi participated in the litigation as the representative of our client(the third party) about the administrative trademark objection review case of No.4704853 related to “KANGWANG and its figure”.During the first instance, attorney Wang Xuezhi held the key of the case, tightly around the cited trademark gaining popularity time to break the evidence of the opposite party one by one,made a thorough analysis of the difference of the goods and services between the opposed trademark and the cited trademark.Finally,the first-instance court support our point of view, hold that it will not result in a consumer’s misunderstanding about the opposed trademark and the cited trademark,safeguarded the legal interests of our client.
However, during the second trial, the opposite party submitted a lot of evidence proving that the cited trademark had judicial protection,attempted to use the trial results of other cases to mislead the judges of this case.But attorney Wang Xuezhi’s wonderful analysis impressed the judges of the second trial and made the second instance court eventually supported our point of view,so we won the last victory.After a two-tier appellate, our client got the complete protection of his rights and interests.
