Graduated from Jilin University School of Law, majoring in economic law, Mr. YANG passed the National lawyer qualification examination and started his practice in 1990. Mr. YANG mainly engaged in legal consulting and other comprehensive law practice before 2015, while since 2015, Mr. YANG, once worked in domestic well-known law firms in the industry for a long time, has mainly handled IP litigation and specializes in cases of trademark infringement and unfair competition litigation. Mr. YANG has provided IP litigation business for well-known foreign companies such as L'OREAL, Colgate, Gillette, Adidas, Volkswagen AG, and famous domestic companies such as Qingdao Haier and Dumex. Many cases he once represented were rated as typical cases.
Typical cases:
- Represented STIHL in trademark infringement and unfair competition cases against a company in Hangzhou, the first case that pure color decoration was granted judicial protection as a "decoration unique to well-known commodities" in China, which was an excellent trademark agency case in 2015-2016(Selected by the Chinese Trademark Association).
- Represented L'Oréal in trademark infringement and unfair competition cases against Milene and a company in Hangzhou, which was listed as one of the top ten cases of the Quality Brands Protection Committee in 2010 and one of the 50 typical cases of intellectual property rights in the Supreme People’s Court.
- Represented Michelin in trademark infringement and unfair competition cases against an electric bicycle company in Tianjin, which was rated as one of the 50 typical cases of intellectual property judicial protection in Chinese courts in 2009.
- Represented Grohe AG in a trademark infringement case against a company in Yuyao and obtained high compensation based on the compensation agreement signed with the defendant, which attracted attention from the industry.
- Represented Colgate in a trademark infringement case against a company in Yiwu. The Trademark Office mistakenly issued the trademark registration certificate without the first trial procedure, and in the case of losing both the first and second instance, the accused trademark went through the procedures of invalidation, review of the refusal and administrative litigation, finally won the case through civil procedures such as retrial and a new trial. The case was rated as the best case of intellectual property protection in 2012-2013 by the quality Brands Protection Committee of China Association of Enterprises with Foreign Investment.
- Represented Haier in trademark infringement and unfair competition cases against a company in Haining and other defendants, determined that it constituted unfair competition on the grounds of improper use of the registered trademark combination by the defendant, which was one of the top ten intellectual property cases in Ningbo in 2011.
- Represented Chivas Regal in a trademark infringement case against a company in Yantai, involving the identification of three-dimensional trademarks, which was one of the few cases of judicial protection of three-dimensional trademarks in China.
- Represented Eastman Kodak Co. in trademark infringement and unfair competition cases against a company in Suzhou, which was selected into the Gazette of the Supreme People's Court, Vol. 5, 2008.
- Represented Lacoste in the trademark infringement case against a clothing Market Management Company in Shanghai. The highlight of this case is that the market manager’s failure to perform the duty of care constituted a joint infringement. This case was selected into the Gazette of the Supreme People's Court in 2009.
- Represented SEB and its affiliates to file lawsuits of dozens of patent infringement cases, and most of them won.
